Smugglers—INA § 212(a)(6)(E)
Any individual who knowingly encourages, induces, assists, abets, or aids any other alien to enter, or to try to enter, the U.S. is inadmissible. This ground requires an "affirmative and illicit act of assistance in shepherding someone across the border.” There is a waiver of this ground of inadmissibility for certain LPRs and others seeking admission as immediate relatives of U.S. citizens or preference immigrants if they are smuggling only their spouse, parent, or child.
